Superblocks Acceptable Use Policy

This Acceptable Use Policy (this “Policy”) describes prohibited uses for all users (“You”) of the programmable platform to build internal tools, applications, workflows, and related services (“Services”) offered by DayZero Software, Inc. dba “Superblocks” (“Superblocks” or “We”) and the related website located at https://app.superblocks.com/ (the “Site”). This policy supplements, and is incorporated into, Superblocks’ Master Services Agreement (currently published at https://superblocks.com/legal/master-Servicess-agreement) (the “MSA”). If any provision in this Policy conflicts with a term in the MSA, then the applicable provisions of MSA will prevail unless the term in this Policy specifically states that it will prevail.

Superblocks may modify this Policy at any time by posting a revised version on the Site. By using the Services or accessing the Site, you agree to the latest version of this Policy.

 

If you violate this Policy, Superblocks may suspend or terminate your use of the Services or access to the Site. Superblocks’ right to suspend or terminate your use of the Services or Site applies even if a breach is committed unintentionally or without your authorization if Superblocks believes that suspension or termination is necessary to ensure compliance with laws or to protect the rights, safety, privacy, security or property of Superblocks, its customers or third parties.

Prohibited Content

You are solely responsible for any content you publish or make available through the Services or Site. You may not use the Services or Site to store, transmit, display, distribute, or share content that is:

  • Defamatory, libelous, threatening, harassing, abusive, hateful, deceptive, or fraudulent
  • Obscene, pornographic, or indecent
  • Harmful to minors, including content that constitutes child exploitation or pornography
  • Otherwise objectionable or in violation of applicable laws or regulations

Harmful Content and Malware

You may not upload, distribute, or make available any content, software, or technology that may harm or interfere with any system, program, or data. This includes, but is not limited to:

  • Viruses, trojan horses, worms, bots, scripting exploits, and other malicious code
  • Any technology designed to intercept, expropriate, or gain unauthorized access to data or systems

Intellectual Property Rights

You may not use the Services or Site in any way that infringes, dilutes, misappropriates, or otherwise violates the intellectual property or proprietary rights of others. This includes, but is not limited to, copyrights, patents, trademarks, and trade secrets.

Security and Integrity

a. System Security Violations

You may not use the Services or Site to compromise the security, integrity, or availability of any network, system, or device. Prohibited activities include, but are not limited to:

  • Unauthorized access to or monitoring of systems or data
  • Scanning, probing, or testing vulnerabilities without authorization
  • Interfering with or disrupting networks, Services, or systems, including denial-of-Services (DoS) attacks
  • Tampering with, reverse-engineering, or attempting to bypass security measures
  • Forging TCP/IP packet headers or any part of the header information in an email or newsgroup posting

b. Privacy Violations

You may not use the Services or Site to violate the privacy or confidentiality of others, including transmitting or exposing personal data without authorization.

Restrictions on Automated Access and Data Collection

You may not:

  • Frame, mirror, or otherwise reproduce the Site without prior written consent
  • Use bots, spiders, scrapers, or any automated means to access, extract, or index content from the Services or Site without explicit permission
  • Circumvent the structure or presentation of the Services or Site

Unsolicited Communications and Misuse of Messaging

You may not use the Services or Site to send:

  • Unsolicited bulk messages ("spam")
  • Excessive or harassing communications
  • Messages with falsified sender information or deceptive headers (e.g., spoofing, phishing)

Responsibility for End Users

You are responsible for ensuring that anyone accessing or using the Services under your account complies with this Policy. Facilitating, encouraging, or assisting others in violating this Policy is considered a violation.

High-Risk Use Prohibited

The Services may not be used in any environment where its failure could lead to:

  • Death or serious bodily harm
  • Physical or environmental damage

Prohibited uses include, but are not limited to, applications related to:

  • Aircraft or human mass transportation systems
  • Nuclear, chemical, or hazardous material facilities

Compliance with Laws

You must use the Services or Site in compliance with all applicable laws and regulations, including those related to data protection, privacy, consumer rights, and export controls. Any use of the Services for unlawful activities is strictly prohibited.

Monitoring and Enforcement

We reserve the right, but do not assume the obligation, to monitor and investigate any use of the Services or Site. We may take appropriate action at our discretion, including but not limited to:

  • Removing or restricting access to content that violates this Policy
  • Reporting violations to law enforcement, regulators, or other relevant parties
  • Cooperating with authorities to investigate and address unlawful activities

Enforcement and Consequences of Violations

We reserve the right, at our sole discretion, to investigate any suspected violations of this Policy and take appropriate action, including but not limited to:

  • Content Removal: We may edit, refuse to post, or remove any material that violates this Policy.
  • Account Suspension or Termination: We may suspend or terminate access to the Services or Site for any user found to be in violation of this Policy.
  • Legal Action and Reporting: We may report any illegal activities to law enforcement authorities, regulators, or third parties, which may include disclosing relevant account information.
  • Cooperation with Authorities: We may assist authorities in investigating and prosecuting violations by providing necessary information, including network and system data related to potential breaches.

Reporting Violations

If you become aware of any activity that violates this Policy, you must promptly report it to legal@superblocks.com and cooperate with us in addressing the issue. Failure to report known violations may itself be considered a violation of this Policy.
